Esta pr\u00e1ctica, que consiste en la creaci\u00f3n de listas negras que registran antecedentes laborales conflictivos, afecta de manera directa a miles de personas y pone en evidencia la falta de regulaci\u00f3n en los procesos de contrataci\u00f3n en el pa\u00eds.<\/p>\n\n\n\n<p>&nbsp;El bur\u00f3 laboral se alimenta de informaci\u00f3n que en su mayor\u00eda proviene de boletines emitidos por las Juntas de Conciliaci\u00f3n y Arbitraje, tanto locales como federales. Sin importar la resoluci\u00f3n de los conflictos, el simple hecho de haber participado en un juicio laboral puede marcar negativamente a los trabajadores al hacer que algunas empresas excluyan a candidatos en sus procesos de selecci\u00f3n bas\u00e1ndose \u00fanicamente en un historial que no refleja las habilidades ni la situaci\u00f3n actual de los colaboradores.<\/p>\n\n\n\n<p>&nbsp;\u201cEl bur\u00f3 laboral es una herramienta discriminatoria que, adem\u00e1s de estar prohibida por el art\u00edculo 133 de la Ley Federal del Trabajo, afecta gravemente las oportunidades laborales de los trabajadores y perpet\u00faa pr\u00e1cticas poco \u00e9ticas en el mercado laboral basadas en datos sesgados o incompletos\u201d, expres\u00f3 Felipe Cuadra, cofundador y CHRO en Rankmi.<\/p>\n\n\n\n<p>De acuerdo con un estudio realizado por OCC Mundial, el 31% de los trabajadores en M\u00e9xico est\u00e1 familiarizado con el t\u00e9rmino \u201cquedar boletinado\u201d, asoci\u00e1ndolo con listas negras que utilizan las empresas para sancionar a colaboradores que enfrentaron conflictos legales o laborales. Mientras que un 16% se\u00f1al\u00f3 que ha sentido presi\u00f3n para actuar en contra de su voluntad, como firmar una renuncia, para evitar ser incluido en estas bases de datos.<\/p>\n\n\n\n<p>Adem\u00e1s de incumplir con la Ley Federal del Trabajo, el bur\u00f3 laboral tambi\u00e9n infringe la Ley Federal de Protecci\u00f3n de Datos Personales en Posesi\u00f3n de los Particulares. Es crucial que las organizaciones trabajen en construir culturas laborales \u00e9ticas que promuevan el respeto y la inclusi\u00f3n\u201d, afirm\u00f3 Felipe Cuadra, cofundador y CHRO en Rankmi.<\/p>\n\n\n\n<p>La soluci\u00f3n, seg\u00fan expertos de Rankmi, radica en la prevenci\u00f3n, la capacitaci\u00f3n constante y la implementaci\u00f3n de pol\u00edticas internas que promuevan la transparencia.
